Insian Rebellion of 1857 Essay The Indian Rebellion on 1857The Indian rebellion of 1857 was one of much needed self respect, and of pride. The Indian people at this time were being Political and social reform in India was achieved as a result of the European political principles brought to India by the British. Indians were Anglicized, and the British ideal for an Indian was to be Indians in blood and color, but English in tastes, opinions and intellect, as put by one British legislator (Rich, 214, 1979). This Western education inevitably led to well-read Indians encountering European principles such as human rights, freedoms of speech, travel and association, and liberalism. This was in direct contrast to the imperialism practiced by the British in India and to the Indian experience one third of the subcontinent was ruled by Indian princes under British supervision, and the rest was directly controlled by the Viceroy and administered by about one thousand members of the civil service, all of them English (Rich, 215, 1979). This knowledge of principles such as autonomy and freedom naturally led to many Indians desiring this for their own nation, understandable since it appeared that the worlds greatest and most powerful nations were self-governing democracies, and this system was obviously successful. Part of the newfound desire for freedom experienced by many Indians was the desire for native religion and customs to be respected. It is widely accepted that the Indian mutiny of 1857 was at least partly generated by Indian resentment of British interference in Hindu customs. Indian soldiers in the army were required to bite the ends off gun cartridges that contained pig fat and cow fat, which offended both Muslims and Hindus. When troops refused to use the cartridges, eighty sepoys were thrown into gaol for disobedience, an act which finally triggered the uprising. (Richards, 301, 1994). This showed a great lack of cultural and religious sensitivity on the part of British officers. Although the mutiny was put down quickly, it shook British confidence in their power, and resulted in tighter control of their hold on India. This in turn led to further resentment of British imperialism, and claims that military regulations were an attempt by the British to destroy the traditional caste system. (Richards, 301, 1994). In believing so vehemently that the British system was superior to the far inferior Hindu traditions, the British officers were essentially contravening the ideals of freedom that were an important element of the Western European political principles that they so wanted to instill in the Indian peoples. Following the Mutiny of 1857, Indian nationalism gained much more momentum than had previously existed in the first part of the century. This movement consisted mostly of British-educated intellectuals, and ironically was made possible by the British encouragement of higher education, originally intended to create a middle management that could carry out simple administration jobs. Most of the Indian nationalists most notably Ghandi were educated in Western Europe and were well read in Western notions of freedoms, civil liberties and autonomy. The Indian National Congress was the largest and most obvious nationalist group, formed so that educated Indianscould express dissatisfaction with the British colonial administration and suggest reforms. (Cowie, 36, 1994) This Congress, however, had no power in terms of action and it can be seen as an attempt by the British to appease Indian nationalists who wanted progress. The seeming uselessness of the Indian National Congress in terms of enforcing changes and reforms can be seen as a great cause of Indian resentment of British nationalism. When looking at Harings work you are able to see that indeed form, shape, and size is not essential, that perfection is not a necessity but that getting the message across is the new perfection, â€Å"By expressing universal concepts of birth, death, love, sex and war, using a primacy of line and directness of message , Haring was able to attract a wide audience and assure the accessibility and staying power of his imagery†( Keith Haring Biography) Plato would have hated this artist for not caring about having knowledge of the medium he was using, for being so free and for not being limited. Modern people have lost a sense of perfection and accuracy in their work because the meaning of the artwork has overpowered its aesthetic surface beauty, this meaning that Platos aesthetic theories no longer limit and gear the modern artist towards perfection. Art is the recreation of something that already exists. Plato refers to this as imitating work when he says, â€Å"Human makers envisage the human community according to the ideas of justice, the good, courage, temperance, and the beautiful. Within the state the various arts are practiced likewise as imitations of an external order of existence† (Philosophies of Art and Beauty pg. 4) Plato talks about how human makers see the world according to certain ideas, which pushes them (while thinking this way) to create/practice art even though in the end they are still imitations of something that already exists. Part of Plato’s theory is right yet an artist’s imagination can’t imitate work but it can create work. This theory compared to how the modern person creates art has to in the sense that yes some artist are imitators but at the same time they are makers because they are taking something that already exists ,feeding it a meaning, giving it a personal twist and recreating the piece . Keith Haring pops at this theory again and challenges it by creating work influenced by social concepts occurring in his human community, â€Å"They were humans and animals in different combinations . A fiduciary is defined as a person who is required to act for the benefit of another person on all matters within the scope of their relationship. In the seminal case Garrett v. Bankwest, Inc., the Supreme Court of South Dakota held that a fiduciary relationship exists between a lender and a borrower only if, (1) the borrower reposes faith, confidence, and trust in the lender, (2) the borrower is in a position of inequality, dependence, weakness, or lack of knowledge, and (3) the lender exercises dominion, control, or influence over the borrower?s affairs. All three of the elements must exist in order to establish a fiduciary duty between a lender and a borrower. The court also held that the relationship between a lender and borrower is generally viewed as a debtor-creditor relationship which imposes no special or fiduciary duties on a bank. The courts have generally ruled that when a fiduciary duty does exist, it is because the relationship between the lender and the borrower goes beyond typical contractual agreements. The majority of cases in Alabama show that the courts hold that lenders do not owe a borrower a fiduciary duty out of a basic creditor-debtor relationship. In Lee v. United Fed. Sav. The buyers applied for and received a loan from the United Federal Savings and Loan Association to purchase a house. After purchasing the house, the buyers found several structural problems and went to United Federal concerning them. United Federal referred the buyers to the firm that had inspected the house, and they then learned that the inspection report written prior to the purchase had identified the structural issues. The buyers filed suit against United Federal and others claiming that they had established ?a confidential relationship, or special circumstances between the parties, under which the law imposed a duty on United Federal to disclose all material information it possessed about the condition of the house.? The court ruled that that just because a financial institution lends money for the purchase of a house, it does not create a confidential relationship which imposes a duty to disclose facts at their disposal (even if they have knowle dge of defects in the house). The court stated that, ?We decline to recognize any such duty between United Federal and the Lees (the buyers) under the facts presented, which indicate to us an arm?s length transaction. Absent a confidential relationship, no duty to disclose exists The court determined that only a debtor-creditor relationship existed and the circumstances do not create a confidential relationship. Therefore, the lender owed no fiduciary duty to the borrower. In McIntyre Electric Serv., Inc. v. SouthTrust Bank of Mobile, McIntyre Electric filed suit against SouthTrust Bank after the bank cancelled the company?s credit and demanded payment on all outstanding loans. McIntyre Electric had conducted business and borrowed money from SouthTrust for eight to nine years prior to filing suit. In 1980 and 1981 the company experienced financial difficulties, was extended credit by SouthTrust and was assured that the bank would ?stand behind McIntyre financially in order that McIntyre Electric might reach financial stability.? McIntyre had contemplated going out of business but had decided to continue operating after receiving the commitment from SouthTrust. In their argument to the court, McIntyre asserted that those circumstances created a fiduciary relationship with SouthTrust. The court ruled that only a debtor-creditor relationship existed and that SouthTrust had no control or influence over McIntyre?s business except as a creditor.
